License Grant Disclaimer of Warranties Limitation of Liability Indemnification Acceptable Use Payments Privacy Third-Party Services Intellectual Property Termination Governing Law Changes to These Terms

1. License Grant

Subject to these terms, WP Health Inspector ("we", "us", "our") grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software solely for your own internal business purposes on the number of WordPress installations permitted by your plan tier.

1.1 Lite Version

The Lite version is made available at no charge and is licensed under the GNU General Public License v2 (or later), consistent with the WordPress.org plugin repository requirements. You may use, copy, and distribute the Lite version in accordance with that license.

1.2 Pro Version

The Pro version is commercial software. Your license is tied to the plan you purchased and the number of active WordPress installations permitted under that plan. You may not:

  • Sublicense, sell, rent, lease, transfer, or assign your license to any third party
  • Redistribute Pro source code or compiled Pro builds outside your own installations
  • Use a single license key to activate the Software beyond the permitted site count
  • Reverse-engineer, decompile, or disassemble any proprietary component of the Pro version
  • Remove, alter, or obscure any proprietary notices, labels, or branding contained in the Software

Multisite: A WordPress Multisite network counts as a single site regardless of the number of subsites within that network. One installation = one site on your license.

2. Disclaimer of Warranties

Important — Please Read THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WP HEALTH INSPECTOR EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: (A) IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; (B) WARRANTIES THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; (C) WARRANTIES THAT THE SOFTWARE WILL OPERATE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS; AND (D) WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY DIAGNOSTIC OUTPUT, RESULT, RECOMMENDATION, OR DATA PRODUCED BY THE SOFTWARE.

WP Health Inspector is a diagnostic tool only. It identifies and surfaces information about the state of a WordPress installation. It does not guarantee that all issues affecting a site will be detected, that diagnostic results are exhaustive, or that acting on any diagnostic output will resolve a site problem or prevent future issues.

You are solely responsible for evaluating the accuracy and completeness of any diagnostic output and for any decisions made in reliance on that output. We expressly disclaim any responsibility for errors, omissions, or inaccuracies in diagnostic results.

Some jurisdictions do not permit the exclusion of implied warranties. If you are located in such a jurisdiction, some of the above exclusions may not apply to you. In that case, the disclaimers apply to the fullest extent permitted under applicable law.

3. Limitation of Liability

Limitation of Liability — Please Read TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WP HEALTH INSPECTOR, ITS OWNERS, DEVELOPERS, EMPLOYEES, CONTRACTORS, LICENSORS, OR AFFILIATES BE LIABLE FOR ANY: (A) INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; (B) LOSS OF PROFITS, REVENUE, BUSINESS, DATA, GOODWILL, OR ANTICIPATED SAVINGS; (C) BUSINESS INTERRUPTION; (D) WEBSITE DOWNTIME, DATA LOSS, OR CORRUPTION; OR (E) COST OF PROCURING SUBSTITUTE GOODS OR SERVICES — ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SOFTWARE OR THIS WEBSITE, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY (INCLUDING CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

3.1 Aggregate Liability Cap

To the maximum extent permitted by law, our total aggregate liability to you for all claims arising out of or relating to the Software or these terms — regardless of the form of action or the basis of the claim — shall not exceed the greater of: (a) the total fees paid by you to us in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) fifty US dollars (USD $50.00).

3.2 Diagnostic Output — No Liability

We are not liable for any action taken, or not taken, in reliance on diagnostic output produced by the Software. This includes but is not limited to: site modifications, plugin removals, server configuration changes, database operations, or any other technical decisions made based on Software output.

3.3 Third-Party Environment

The Software operates inside third-party environments (WordPress, web hosts, servers, PHP runtimes) that we do not control. We are not liable for any incompatibility, conflict, failure, or damage arising from the interaction of the Software with your specific environment, hosting configuration, installed plugins, themes, or custom code.

3.4 Read-Only Operation

WP Health Inspector is designed and engineered to be entirely read-only — it does not write to, modify, or delete any data in your WordPress database or filesystem. While this is a core design constraint, we make no warranty and accept no liability for any unintended interaction with third-party plugins, hosting environments, or custom code that may produce unexpected outcomes.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In those jurisdictions, our liability is limited to the fullest extent permitted by applicable law.

4. Indemnification

You agree to defend, indemnify, and hold harmless WP Health Inspector and its owners, developers, contractors, officers, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of or access to the Software or this website
  • Your violation of these terms
  • Your violation of any applicable law, rule, or regulation
  • Any action taken, or not taken, in reliance on diagnostic output produced by the Software
  • Any content you submit to us, including via contact forms or support channels
  • Your infringement of any intellectual property or other rights of any third party

We reserve the right to assume exclusive control of the defence of any matter subject to indemnification by you, in which case you agree to co-operate with our defence of that claim.

5. Acceptable Use

You agree not to use the Software or this website to:

  • Violate any applicable local, national, or international law or regulation
  • Attempt to circumvent, reverse-engineer, or bypass any license enforcement mechanism
  • Use the Software on WordPress installations beyond the limit permitted by your plan
  • Share, resell, or redistribute license keys
  • Represent the Software as your own product or remove attribution
  • Use automated means to scrape, monitor, or extract data from this website
  • Introduce malicious code, viruses, or disruptive data via any contact or support channel

We reserve the right to suspend or terminate your access to the Software and any associated services immediately and without notice if we determine, in our sole discretion, that you have violated this Acceptable Use policy.

6. Payments

6.1 Payment Processing

All payments are processed by Lemon Squeezy, a third-party payment and merchant-of-record platform. By completing a purchase you also agree to Lemon Squeezy's applicable terms of service and privacy policy. We do not store your payment card details.

6.2 Pricing

All prices are quoted in US dollars and are exclusive of any applicable taxes. Taxes (VAT, GST, sales tax, etc.) may be assessed by Lemon Squeezy at checkout based on your billing location. We reserve the right to change pricing at any time; changes do not affect active subscriptions until their renewal date.

6.3 Annual Subscriptions

Pro plans are billed annually. Your subscription renews automatically on its anniversary date unless cancelled prior to renewal. You are responsible for cancelling your subscription before renewal if you do not wish to be charged.

6.4 Refund Policy

All sales are final. We do not offer refunds as a matter of policy. Refund requests may be considered at our sole and absolute discretion on a case-by-case basis. Submitting a refund request does not entitle you to a refund, and we are under no obligation to grant one. To submit a request, contact us at support@wphealthinspector.com with your Lemon Squeezy order number and a description of your situation.

7. Privacy & Data

7.1 Plugin Data

WP Health Inspector runs entirely within your WordPress installation. No diagnostic data, site content, database contents, user data, or scan results are transmitted to our servers at any point during normal operation. All diagnostic processing occurs locally on your server.

7.2 License Validation

The Pro version communicates with Lemon Squeezy's API solely for the purposes of license key validation and activation status checks. This communication transmits only your license key and a site identifier hash — no site content, user data, or diagnostic results are included.

7.3 Website and Contact Forms

When you contact us via the contact form on this website, we collect the information you voluntarily submit (name, email address, message). This information is used solely to respond to your enquiry and is not shared with third parties except as required by law. We do not sell your personal data.

7.4 Cookies and Analytics

This website may use cookies and analytics tools (including those set by WordPress itself) to understand how visitors use the site. No personally identifiable information is collected through analytics without your consent.

7.5 Data Retention

Contact form submissions are retained for a reasonable period to facilitate support continuity and are deleted upon request. To request deletion of your personal data, contact us at support@wphealthinspector.com.

7.6 GDPR and International Users

If you are located in the European Economic Area, United Kingdom, or another jurisdiction with applicable data protection legislation, you may have rights including the right to access, correct, or delete personal data we hold about you. Please contact us to exercise these rights.

8. Third-Party Services

The Software and this website interact with the following third-party services. We are not responsible for the practices, terms, or availability of these services.

  • Lemon Squeezy — payment processing, license key management, and merchant-of-record services. Subject to Lemon Squeezy's own terms and privacy policy.
  • WordPress.org — the Lite version is distributed via the WordPress.org plugin repository and is subject to WordPress.org's guidelines and terms.
  • Google Fonts — this website loads fonts from Google's CDN. Google may collect data in accordance with its privacy policy.
  • Font Awesome CDN — this website loads icon assets from the cdnjs CDN. Subject to cdnjs terms.

Links on this website to third-party sites are provided for convenience only. We do not endorse, control, or accept responsibility for the content or practices of any linked site. Visiting third-party links is at your own risk.

9. Intellectual Property

All content on this website — including but not limited to text, graphics, logos, design, and the compiled Pro plugin code — is the intellectual property of WP Health Inspector and is protected by applicable copyright and intellectual property laws.

The Lite plugin is open-source software licensed under the GNU General Public License v2 (or later). The Pro plugin contains proprietary components that are not covered by the GPL and may not be redistributed.

"WP Health Inspector" and associated logos are trademarks of WP Health Inspector. You may not use our trademarks in connection with any product or service without prior written permission, or in any manner that is likely to cause confusion or disparagement.

10. Termination

We may suspend or terminate your license and access to the Software at any time, with or without cause, and with or without notice, including in the event of a violation of these terms.

Upon termination of a Pro license for cause (e.g. terms violation), no refund will be issued. Upon termination by us without cause, a refund of any prepaid annual subscription fees may be considered at our sole discretion on a case-by-case basis and is not guaranteed.

Sections that by their nature should survive termination — including Sections 2 (Disclaimer of Warranties), 3 (Limitation of Liability), 4 (Indemnification), and 9 (Intellectual Property) — shall survive any termination or expiry of these terms.

11. Governing Law & Disputes

These terms are governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these terms or your use of the Software shall first be attempted to be resolved informally by contacting us at support@wphealthinspector.com. If a dispute cannot be resolved informally within 30 days, it shall be resolved by binding arbitration conducted in accordance with the rules of the American Arbitration Association, and judgment on the award rendered may be entered in any court of competent jurisdiction.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

If you are a consumer located in the European Union, mandatory consumer protection provisions of your country of residence may apply and cannot be waived by these terms.

12. Changes to These Terms

We reserve the right to modify these terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page. If you have an active paid subscription, we will make reasonable efforts to notify you of material changes by email.

Your continued use of the Software after any modification to these terms constitutes your acceptance of the revised terms. If you do not agree to the revised terms, you must stop using the Software.
